1. Definitions

• “Client”: Brands/businesses purchasing video services.
• “Talent”: Individuals featured in videos.
• “Content”: Videos produced by JKM Fashion.

2. Services

• JKM Fashion provides short-form video production for social media (TikTok/Reels/Shorts).
• Packages include (but are not limited to):
  • Tier 1 (1 video), Tier 2 (3 videos), Tier 3 (5 videos).
  • Talent casting, styling, editing, and platform optimization.

3. Client Obligations

• Provide accurate project briefs (outfits, talent preferences, deadlines).
• Pay 50% deposit upfront (balance on delivery).
• Credit JKM Fashion when reposting Content (e.g., “Video by @JKMfashion”).

4. Talent Obligations

• Submit truthful information (age, sizes, social handles).
• Minors require parent/guardian consent.
• No filters/edits on audition videos.

5. Payments & Refunds

• Payments processed via PayFast (card/EFT).
• No refunds after shoot scheduling.
• Late payments incur 5% monthly interest.

6. Intellectual Property

• Clients receive unlimited usage rights to Content.
• JKM Fashion retains the right to:
  • Use Content for portfolio/marketing.
  • Whitelabel videos for other clients (unless exclusivity is purchased).

7. Cancellations & Rescheduling

• Clients: 48hr notice for shoot changes; forfeit deposit if <24hr.
• Talent: No-shows banned from future projects.

8. Limitation of Liability

• JKM Fashion is not liable for:
  • Platform algorithm changes affecting engagement.
  • Client disputes with Talent.
  • Delays due to force majeure (load-shedding, strikes, etc.).

9. Governing Law

• These Terms are governed by South African law (Western Cape High Court jurisdiction).

10. Dispute Resolution

1. Email connect@jkmfashion.co.za to resolve disputes.
2. Unresolved issues escalate to SA arbitration.

11. Amendments

• Updated Terms posted on www.jkmfashion.co.za; continued use = acceptance.

Acceptance Clause:
“By paying a deposit or submitting talent materials, you agree to these Terms.”
