1. Information We Collect

• From Clients:
  • Name, contact details, business registration/VAT numbers (for invoicing).
  • Project creative briefs (mood boards, outfit details, talent preferences).
• From Talent:
  • Name, age, ID/passport copies (for age verification), physical characteristics (size/body type).
  • Social media handles (TikTok/Instagram), unfiltered audition videos.
• Payment Data (via PayFast):
  • Billing address, transaction history (PayFast processes card/bank details; we only receive confirmation notices).

2. Legal Basis for Processing (POPIA §11)

• Contractual Necessity: To fulfil video production agreements.
• Consent: For talent submissions and marketing communications (opt-in required).
• Legitimate Interest: Improving services via analytics.

3. How We Use Your Data

• To create/deliver video content as per contracts.
• For talent-client matching based on project requirements.
• PayFast payment processing (see Section 6).
• Compliance with SA tax laws (retaining invoicing records for 5 years).

4. Data Sharing & Third Parties

• PayFast: Payment processing only (view PayFast’s Privacy Policy).
• Talent/Clients: Shared strictly for project execution (e.g., talent profiles with clients).
• Never sold to external marketers.

5. Data Retention (POPIA §14)

• Client/talent data: 2 years post-last engagement (or as required by SA law).
• Financial records: 5 years (Tax Administration Act compliance).
• Unsuccessful talent videos: Deleted after 90 days.

6. PayFast Payment Processing

• We integrate PayFast for secure transactions; they handle all card/bank details.
• We only receive:
  • Payment confirmation notices.
  • Client billing addresses (for invoicing).
• Note: PayFast is PCI-DSS compliant (SA’s highest payment security standard).

7. Your Rights (POPIA Chapter 3)

• Access/Correct your data (email connect@jkmfashion.co.za).
• Withdraw Consent (e.g., marketing emails).
• Lodge Complaints with the SA Information Regulator (inforeg@justice.gov.za).

8. Security Measures

• Encrypted online forms (SSL).
• Access restricted to JKM staff with POPIA training.
• Regular audits of PayFast integration.

Changes posted here with revised “Last Updated” dates.
